Terms of use
Safety notice, in plain words
SeaSafe is a reference tool. It is not a navigation system, not a weather service, not a certified safety device and not a substitute for training, official publications or professional advice. Its answers are generated by artificial intelligence from sailing textbooks and have not been reviewed by a qualified instructor. They can be incomplete or wrong. The skipper is responsible for every decision on board. In an emergency, call for help on VHF channel 16 or by any other available means first.

1. Who we are
SeaSafe is published by ULADZISLAU DZIARKACH SYSTEMS, a sole proprietorship registered in Poland, NIP 5842868641, ul. Obrońców Wybrzeża 17/902, 80-398 Gdańsk, Poland, email info@dervlad.com ("we", "us"). "You" means the person who installs or uses the app.
2. What SeaSafe is and is not
SeaSafe is a mobile application that stores a collection of sailing textbooks and the International Regulations for Preventing Collisions at Sea on your device, together with a language model that runs on the device, and lets you ask questions in plain language. It also contains emergency reference cards.
SeaSafe is not:
- a navigation aid, chartplotter, electronic chart or positioning system;
- a weather, tide or warning service;
- an approved or certified safety, distress or communication device under SOLAS, national maritime law or any classification rule;
- a substitute for official publications (nautical almanacs, pilot books, notices to mariners, the official text of the COLREGs and national regulations), for a boating qualification, or for the judgement of a competent skipper;
- medical advice.
Where anything in the app conflicts with an official publication, a competent authority, or your own training, the official source and your training prevail.
3. Your licence to use the app
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the app on devices you own or control, for your own non-commercial use, under the rules of the store you got it from (Apple's Licensed Application End User License Agreement or Google Play's terms also apply). You may not copy, modify, decompile, extract the handbook content or the model for use outside the app, rent, sell or sublicense the app, or remove any notice in it. Open-source components included in the app are licensed under their own terms, listed inside the app.
4. AI-generated answers
Answers in the chat are produced by a language model running on your device, from passages it retrieves from the handbook. You acknowledge that:
- the model can misunderstand a question, select an irrelevant passage, omit something important or state something that is incorrect;
- answers are marked "AI answer, not expert-reviewed" because no instructor or surveyor has checked them;
- the handbook texts reflect their authors' views and publication dates and may not match current regulations in your waters;
- each answer shows its source so that you can read the original; you agree to use the answers as a starting point for your own judgement, not as instructions to be followed blindly.
Quality indicators the app may show (such as a note being marked reviewed or unreviewed) describe our editorial process and are not a warranty.
5. Emergency cards
The emergency cards summarise widely published procedures. They are provided to help you remember steps under stress. They do not call anyone, transmit anything or replace your boat's safety equipment, your training or the instructions of rescue services. The Mayday card gives a template for a distress call; you are responsible for your boat's radio licence, correct use of the equipment and following the instructions of the coastguard or rescue coordination centre.
6. Device requirements and downloads
The app needs a supported phone with enough memory (as stated in the store listing) and a one-time download of a language model of up to about 2.6 GB over a network connection you provide. Mobile data charges from your carrier are your responsibility; we recommend Wi-Fi. We may change the model files or their sizes in updates. The app verifies downloaded files with a checksum and will refuse a damaged file.
7. Free use, purchases and refunds
The app is free to install. Free use includes a limited number of chat questions per day (currently three) and unlimited use of the emergency cards. Full access is a one-time in-app purchase that removes the daily question limit on all devices signed in with the same store account. There is no subscription and no automatic renewal.
The price is shown in the store before you buy and includes applicable VAT. The purchase is made with and billed by Apple or Google under their terms; they are the merchant of record. Refunds are handled by the store: for the App Store at reportaproblem.apple.com, for Google Play through your order history. Where you are a consumer in the EU, you agree that delivery of the digital content starts immediately after purchase and acknowledge that you thereby lose the statutory right of withdrawal, to the extent the store's process does not already cover this. If you have a problem the store will not resolve, write to us and we will try to help.
We may change the free limit or the price of full access for future purchasers. A purchase already made is not affected.
8. Intellectual property
The app, its design, the SeaSafe name and mark, the structure and editing of the handbook notes and the emergency cards are owned by us or licensed to us. The underlying textbooks remain the property of their authors and publishers and are used in the app under licence or applicable law; nothing in these terms transfers any right in them to you. The language model is an open-weights model used under its own licence. You keep ownership of the text you type into the app.
9. Acceptable use
You agree not to use the app in breach of law, to attempt to extract the model or handbook in bulk, to interfere with the download servers, to circumvent the free-question limit or the purchase check, or to present the app's output as professional, certified or official advice to others.
10. Updates and availability
We may release updates that change features, content, models or device requirements, and we may stop supporting old versions. The app's core functions work offline, so they do not depend on our servers being up; downloads and purchase restoration do, and we do not promise uninterrupted availability of those. We may discontinue the app with reasonable notice; content already installed keeps working on your device for as long as the operating system allows.
11. Liability
Going to sea involves risk that no app can remove. To the fullest extent permitted by law:
- the app is provided "as is" and "as available", without warranty of accuracy, completeness, fitness for a particular purpose or uninterrupted operation;
- we are not liable for any loss, damage, injury or death arising from reliance on the app's answers or cards, from a decision taken or not taken at sea, from the unavailability of the app, or from loss of data on your device;
- our total liability to you for all claims arising from the app is limited to the amount you paid us for it in the twelve months before the claim.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for intentional misconduct or gross negligence, or your statutory rights as a consumer.
12. Consumer rights
If you use the app as a consumer, the mandatory consumer-protection law of your country of residence applies and these terms do not take away rights it gives you. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and do not undertake to take part in dispute resolution before a consumer arbitration board.
13. Privacy
How we handle data is described in the privacy policy, which is part of these terms. In short: your questions stay on your device, and we hold almost nothing about you.
14. Ending the agreement
You can end the agreement at any time by uninstalling the app. We may end it if you materially breach these terms. Sections 8, 11, 15 and any other provision which by its nature should survive, survive termination.
15. Governing law and disputes
These terms are governed by Polish law. If you are a consumer, you also keep the protection of the mandatory rules of the law of your country of residence, and you may bring proceedings in the courts of that country or of Poland. For non-consumers, the courts of Gdańsk, Poland have exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
16. Changes to these terms
We may update these terms when the app or the law changes. The current version is always at this address with its date. Material changes will be shown inside the app before they take effect; continuing to use the app after that means you accept them. If you do not, uninstall the app.
